1. General Provisions, Definitions
1.1 The purpose of these Terms and Conditions of Delivery is to govern the formation and performance of contracts that you—hereinafter referred to as the “Customer”—enter into via our online store at http://www.wrbls.eu.
1.2 The online store is operated by Pole Position Textiles International GmbH, represented by Managing Director Horst Meißner, Am Alten Pütt 12, 45772 Marl, Tel.: +49 2365 201306, registered in the Commercial Register of the Gelsenkirchen Local Court under registration number HRB 11698, VAT ID number: DE285733713 – hereinafter referred to as WRBLS.
1.3 Orders and contract performance are based exclusively on these Terms of Delivery. WRBLS does not recognize any deviating terms and conditions unless expressly agreed to in writing.
1.4 A consumer is any person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity. An entrepreneur is anyone who, at the time of concluding the contract, is acting in the course of their commercial or self-employed professional activity.
1.5 The Terms and Conditions and the order form may be saved or printed.
- Order Process, Conclusion of Contract
2.1 The product descriptions in the online store do not constitute binding offers.
2.2 Customers can customize products in the configurator (e.g., colors, logos).
2.3 By clicking “Place Order” (which constitutes a binding offer), the customer submits a binding offer and confirms that all information is accurate. The customer assumes responsibility for all information and representations contained therein. Subsequent complaints that deviate from the ordering process are excluded due to the customized nature of the product.
2.4 The customer will first receive an automatic order confirmation. The contract is not concluded until a separate order confirmation is issued.
2.5 The contract language is German.
- Delivery, Product Availability, Prices, Shipping Costs
3.1 Delivery time is generally up to four weeks after order confirmation.
3.2 If a product is not available, the customer will be informed. No contract is concluded.
3.3 All prices include the statutory value-added tax.
3.4 Shipping costs are shown during the ordering process.
3.5 Shipping is handled by a shipping company. WRBLS bears the risk for consumers.
3.6 The goods must be inspected for quantity and integrity within 24 hours of delivery. Damage to the packaging or the goods must be reported to the carrier or seller immediately and documented.
- Retention of Title
The goods remain the property of WRBLS until full payment has been made. Merchants are liable for careful handling until transfer of ownership.
- Warranty
5.1 The statutory provisions (§§ 434 ff. BGB) apply. For business customers: warranty period of 12 months.
5.2 Slight color variations in textile printing or slight variations in size do not constitute a defect.
- Liability
6.1 WRBLS is liable in the event of:
– Injury to life, limb, or health
– Gross negligence or willful misconduct
– Breach of material contractual obligations (cardinal obligations)
6.2 In cases of simple negligence: Liability is limited to typical, foreseeable damages.
6.3 Also applies to legal representatives and vicarious agents.
6.4 No limitation applies in cases of fraudulent concealment, assumption of warranty, or product liability.

WRBLS treats personal data confidentially and uses it exclusively for contract fulfillment. Details can be found in the Privacy Policy.
- Cancellation Policy
8.1 Right of Cancellation
Consumers have the right to cancel within 14 days of placing an order without providing a reason.

Consequences of withdrawal:– Refund including standard shipping costs within 14 days
– Refund via the original payment method
– Withholding of refund until return or proof of return
– Return within 14 days at your own expense
– Compensation for diminished value if the goods are in poor condition

To meet the deadline, it is sufficient to send the notice in a timely manner.
Consequences of withdrawal:– Refund, including standard shipping costs, within 14 days
– Refund via the original payment method
– Withholding of refund until the goods are returned or proof of return is provided
– Return within 14 days at your own expense
– Compensation for diminished value if the goods are in a deteriorated condition

8.3 Exclusion of the Right of Withdrawal
No right of withdrawal applies to products that have been manufactured to customer specifications or clearly personalized.
9. Consumer Dispute Resolution
WRBLS is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
10. Third-Party Rights, Indemnification
10.1 The customer is solely responsible for verifying whether their designs are permissible.
10.2 No infringement of copyright, trademark, design, or competition law.
10.3 The customer shall indemnify WRBLS against all claims by third parties in the event of any violations.
11. Use as Reference & Self-Promotion
11.1 WRBLS may name the customer as a reference and publish designs.
11.2 This provision shall not apply in the event of a valid objection by the customer.
12. Final Provisions
12.1 Should individual clauses be invalid, the remainder of the contract remains valid.
